After the case is denied by the immigration judge, the person on behalf of which the case is denied has the right to file an appeal within 30 days of the decision to the Board of Immigration Appeals. If the Board of Immigration Appeals affirms the immigration judge’s decision, then there is another level of appeal to the United States Circuit Court of Appeals depending on which circuit the case is heard. This process is referred to as “Petition for Review”. In this process federal judges decide whether the Board of Immigration Appeals decided the case correctly.
